LaRébenne General Terms and Conditions of Sale

1/ Registration

Registration Terms: These general terms and conditions of sale govern the package tour offers proposed by LaRébenne. The participant acknowledges having read and accepted them before confirming their booking. In the case of a group registration, the person making the booking on behalf of the various trip participants acknowledges having read them and undertakes to transmit them to each traveller along with all information provided by LaRébenne concerning the trip. Trips offered to pre-established groups may be subject to specific conditions: in this case, they will be communicated to the client with the quote.

From our website www.larebenne.com (hereinafter the "Site"), we provide detailed information on the nature and specifics of each tour. You can consult the day-by-day programme, practical information about the destination, and all useful information for its completion (level of physical and technical involvement, minimum number of participants, etc.). We draw your attention to the fact that we offer trips that may require varying degrees of physical and technical commitment (riding/cycling skills). Consequently, we recommend that you carefully read the information relating to the level of physical and technical involvement required to undertake the planned trip. It is the responsibility of each traveller to determine, based on the information provided, whether they have the necessary capabilities. In case of doubt and before any registration, we invite you to contact LaRébenne as well as any specialist (e.g. your doctor in case of medical history) to confirm your ability to undertake the planned tour.

Any registration for a travel package must be made using the booking form completed and validated by the participant on the website "www.larebenne.com" or by means of the registration form signed by each participant and be accompanied by a deposit of 30% of the total trip price per participant.

For any online registration, receipt of an email from LaRébenne confirms that the registration and deposit have been received, but does not constitute confirmation of the departure for which the registration was made. Registration will only be confirmed upon sending by LaRébenne of a departure confirmation email. The booking will then be considered definitively reserved and confirmed. In accordance with Art. L.121-21-08 of the French Consumer Code, once the registration has been validated on the website, the participant can no longer benefit from a withdrawal period.

The participant must pay the balance of the trip price no later than 30 days before departure. If registration was made via the LaRébenne website, the participant will receive an email requesting payment of the balance approximately 40 days before departure (with a link allowing online payment).

Given the specificities of trips offered by LaRébenne, a minimum number of participants may be required. This number is then specified in the trip's technical sheet. The booking is concluded subject to the suspensive condition that the minimum number of participants is reached.

Self-guided trips and pre-established group trips are subject to specific terms of sale that supplement and/or modify these general terms and conditions of sale. These specific terms of sale will be attached to proposals relating to these types of trips.

Registration must be made using the participant's first and last names as they appear on their passport or the identity document used for the trip. If names are changed after registration, modification or repurchase fees for the airline ticket, with a minimum amount of €100, will be charged by LaRébenne.

It is the participant's responsibility to verify that the spelling of names on travel documents (tickets, visa, etc.) matches those on identity papers. In case of non-compliance, the participant will not be entitled to any refund in case of denied boarding.

Minors: A minor must be registered on the same booking as a responsible adult. Registrations for minors must be signed by the parent(s) exercising parental authority and/or guardian with the mention "father's, mother's agreement...". For the trip, the minor must have all documents allowing them to leave the territory. If the minor travels with their identity card to or via a country not requiring a passport, customs authorities may require a document proving that the accompanying person is indeed the parent (family record book or birth certificate).

The minor remains under the responsibility of the holder of parental authority throughout the trip, regardless of the activities undertaken and despite the presence of a guide. LaRébenne's liability cannot be engaged in case of lack of supervision. If the minor travels without their parents, contact details in France must be provided to LaRébenne before departure.

Physical Fitness: The participant must ensure that their physical condition is suitable for the planned trip. LaRébenne cannot be held responsible in case of physical insufficiency revealed particularly during the trip. LaRébenne reserves the right not to accept a participant who does not meet the level criteria specified as indicative in the technical sheet and to refuse to allow the participant to continue their trip if this would prove dangerous both for themselves and for other group members, without the participant being able to contest the decision made by LaRébenne or claim any compensation or refund in this regard.

Administrative and Health Formalities: Information relating to administrative and health formalities is provided by LaRébenne. It is the responsibility of each participant to ensure before departure that they comply with police, customs and health formalities (passport, visa, vaccination certificate) and to respect these formalities during the trip. This information is set out in the technical sheet prior to ordering. It may change depending on changes in the country's administrative situation. It concerns French nationals. Foreign nationals are advised to check with the consulate or embassy of the countries visited whether this information applies to their personal situation.

All costs relating to these procedures are the responsibility of the participant. No refund of the trip price will be made if the participant is unable to depart due to non-compliance with these formalities.

Safety: It is the responsibility of each participant to read the safety instructions issued by local authorities and the travel recommendations made by the Ministry of Foreign Affairs on the website www.diplomatie.gouv.fr and to comply with them. As this information may change up until the departure date, it is strongly advised to consult it regularly.

2/ Price and Payment Terms

Trip Price: Services included in the price are indicated in the trip's technical sheet. The total invoiced price may differ from that shown in the catalogue or in the registration request, particularly due to additional services requested by the participant and air transport price adjustments (fuel surcharge adjustment, seat repurchase or class change). The total trip price, including any supplements, is communicated to the participant for approval, then stated on the invoice. A flat processing fee will be charged for early or deferred departure (currently €50 per participant).

Specific Conditions Applicable to Self-Guided Trips: The indicated price corresponds to a standard tour, booked no later than 15 days before departure. For "Self-Guided" trips, bookings are made upon receipt of your registration, for the dates of your choice; it may therefore happen that certain services are no longer available. In this case, LaRébenne may offer to change your travel dates, change tour or formula, or choose other services, with a price adjustment. If none of these solutions suits you, LaRébenne will cancel the registration and refund all amounts paid. For any registration less than 15 days before departure, priority processing fees per booking will apply. The amount of these fees is indicated in the descriptive sheets of the relevant tours.

Price Revision Terms: The price of our trips is firm, final and in euros. However, in accordance with Article L211-12 of the French Tourism Code, the price may be adjusted upward or downward, up to 20 days before the departure date, without possibility of cancellation/termination on your part, for one or both of the following price changes:

  • passenger transport resulting from the cost of fuel or other energy sources
  • the level of taxes or fees on travel services included in the contract, imposed by a third party not directly involved in the performance of the contract, including tourist taxes, landing or embarkation and disembarkation taxes at ports and airports.

Any refusal by the traveller(s) to pay this adjustment, provided it is not significant, will be considered as cancellation/termination by the traveller(s) and the cancellation/termination fees in Article 5.1 will apply.

Payment Terms: The balance including additional services, any air supplements, insurance and assistance, is payable one month before departure. Failing payment of the balance one month before departure, LaRébenne may cancel the booking without compensation and will apply the cancellation fees mentioned in Article 4. In case of registration less than one month before departure, the full trip price is payable upon registration.

3/ Cancellation Insurance and Assistance(*): It is essential to have comprehensive coverage: cancellation costs, rescue and repatriation during the trip, advance medical expenses, baggage theft, etc. LaRébenne offers each participant the option to take out comprehensive insurance. If the client chooses to take out one of these formulas, the notice detailing all guarantees and claim declaration procedures, available on our insurance page, will be sent upon departure confirmation. The LaRébenne guide-leader will be aware of it, but only the participant is responsible for complying with claim declaration procedures. The participant must therefore keep this agreement with them during the trip.

Assistance and Cancellation Insurance: "Comprehensive" Contract (4.5%), minimum premium €15: Assistance-repatriation + tour interruption + baggage + cancellation.

"Bank Card Comprehensive" Contract (3.8%), minimum premium €15: Assistance + stay interruption + baggage + cancellation as supplement to your credit card (only for payment with Gold, Platinum, World Elite Mastercard, or Premier or Infinite Visa. Bank cards issued by a French bank only).

"Cancellation" Contract (2.5%), minimum premium €10: Cancellation only.

"Repatriation Assistance" Contract (1.6%), minimum premium €10: Repatriation assistance + tour interruption + baggage.

Please note, these contracts are valid for European residents only. Regarding "civil liability abroad" coverage, only French residents are covered.

*Please note, this description is not contractual, and you should consult the specific general conditions for each contract (available on our website). Any reimbursement of cancellation fees by the insurance is calculated from the date of first manifestation of the event triggering the guarantee. Cancellation must therefore be made as soon as possible and from the first manifestation. If the participant uses their personal contracts, they must, from the first day, indicate in writing to their guide-leader the company name, contract number and telephone contact.

4/ Client-Requested Modifications:

Cancellation: Whatever the reason, they must immediately notify LaRébenne and the insurer by any written means allowing acknowledgement of receipt (by postal mail or email). LaRébenne reimburses the full trip price less the following cancellation fees (per person):

For trips sold with air services:

  • More than 60 days before departure: 30% of trip price excluding insurance premium.
  • 60 to 31 days before departure: 40% of trip price excluding insurance premium.
  • 30 to 21 days before departure: 50% of trip price excluding insurance premium.
  • 20 to 14 days before departure: 60% of trip price excluding insurance premium.
  • 13 to 7 days before departure: 75% of trip price excluding insurance premium.
  • Less than 7 days before departure: 100% of trip price excluding insurance premium.

For trips sold without air services:

  • More than 60 days before departure: 5% of trip price excluding insurance premium.
  • 60 to 31 days before departure: 15% of trip price excluding insurance premium.
  • 30 to 21 days before departure: 30% of trip price excluding insurance premium.
  • 20 to 14 days before departure: 50% of trip price excluding insurance premium.
  • 13 to 7 days before departure: 70% of trip price excluding insurance premium.
  • Less than 7 days before departure: 100% of trip price excluding insurance premium.

If the cancellation insurance contract has been taken out, it will apply for the reasons provided in the contract, after examination of supporting documents by the insurer. Trip cancellation does not exempt from full payment of the trip; any reimbursement procedure by the insurance can only be initiated under this condition. Specific cancellation conditions apply to trips with cruises, described in the technical sheets of these trips. For flights only, the cancellation conditions applied are those of the airline. Visa issuance fees and other customs clearance documents, air taxes not reimbursed by insurance, registration fees and insurance fees cannot be refunded under any circumstances.

Special Case of Self-Guided Trips: Given the specificity of these trips, a minimum of two adults may be required. Therefore, if cancellation by one or more participants results in only one participant remaining, the remaining participant's registration will then also be automatically cancelled. The cancellation fees provided in the general terms and conditions of sale and their possible coverage by cancellation insurance are then applicable to all travellers concerned.

Trip Change or Modification at Participant's Request: Any request for trip modification (change of tour or modification of dates) will incur modification fees identical to the cancellation fees mentioned above. Any request for modification of additional services made less than 30 days before departure will incur the following fees:

  • addition of an additional service: €50 late request fee plus cost of the additional service in question
  • modification of an additional service: €50 late request fee plus any price difference between the initial request and the new request
  • removal of an additional service: application of the scale below: 30 to 21 days before departure: 30% of the additional service price. 20 to 14 days before departure: 50% of the additional service price. 13 to 7 days before departure: 70% of the additional service price. Less than 7 days before departure: 100% of the additional service price.

Modification During Trip at Participant's Request: Any programme modification made at the participant's request (extension, deferred return, hotel modification, etc.) can only be implemented after guide approval and will be subject to availability and payment of related costs by the participant.

Contract Transfer: In case of contract transfer, the client must inform LaRébenne at least 7 days before departure by registered letter with acknowledgement of receipt. This transfer is possible subject to air transport availability and adequate level of the transferee. It may incur additional costs (particularly in case of airline ticket modification), which will be invoiced to the designated transferee. In any event, the transferor and transferee are jointly and severally liable for payment of the trip price and any additional fees.

Trip Interruption: Any trip interrupted by participant decision (for health reasons, level, or other) does not entitle to any refund by LaRébenne of unused services. Additional costs incurred by the participant as a result will not be reimbursed.

5/ Modifications by LaRébenne:

Cancellation by LaRébenne:

Due to insufficient number of participants: When the minimum number of participants is not reached, the trip may be cancelled at the latest:

  • 20 days before the start of the trip or stay for trips lasting more than 6 days
  • 7 days before the start of the trip or stay for trips lasting 2 to 6 days
  • 48 hours before the start of the trip or stay for trips lasting no more than 2 days

In this situation, LaRébenne is not required to provide any compensation or indemnity to the participant. The client is informed by email or telephone. The client then has the choice between full refund of amounts paid or transfer to another trip of their choice up to the amounts paid. All costs incurred by the participant remain their responsibility (purchase of transport tickets, hotel, equipment necessary for the trip, administrative fees).

Due to force majeure: Events constituting force majeure (unforeseeable and insurmountable incidents or events such as: wars, political unrest, strikes, riots, weather conditions, natural disasters, etc.) may require trip cancellation. In this case, the client is immediately informed by email or telephone. The client then has the choice between refund or transfer to another trip of their choice up to the amounts paid; they cannot then claim any compensation.

Trip Modification: Before departure, programme modifications (dates, times, itineraries, supervision, accommodation, etc.) may occur due to organisational difficulties or safety issues. Each participant is then informed by LaRébenne. If this modification affects an essential element of the programme, the participant has the option either to terminate the contract without claiming any compensation, or to accept the modification proposed by LaRébenne. The participant's appearance at departure constitutes acceptance of the modifications.

During the trip, programme modifications (dates, times, itineraries, supervision, accommodation, stage reversal, etc.) may occur due to organisational difficulties or safety issues. If LaRébenne is able to, replacement services are offered to the participant. Failing that, and except in case of force majeure, LaRébenne will refund the price difference between the planned services and those provided.

Trip Interruption: Any trip may also be interrupted by guide decision for duly justified reasons. In this case, unless the interruption is due to force majeure, LaRébenne refunds the price difference between the planned services and those provided.

6/ Liability:

Civil Liability: In accordance with regulations governing our profession, LaRébenne is insured for Professional Civil Liability up to €3,811,225 per insurance year regardless of the number of victims. However, LaRébenne's liability does not replace the individual civil liability that each participant must hold.

Specific Conditions Applicable to Self-Guided Trips: The tour takes place without a guide and, as such, under the full responsibility of each traveller. Each traveller must notably:

  • be able to read a map and follow an itinerary with orientation equipment (compass, GPS)
  • navigate using any GPS tracks, travel booklet indications and maps provided
  • be able to create and follow an alternative itinerary if needed (fatigue, mechanical problem, weather conditions, closed road or track, etc.)
  • handle mechanical problems
  • choose a departure time suited to the difficulty of stages and each traveller's cycling pace, allowing a wide safety margin
  • check daily weather conditions and safety conditions
  • arrive on scheduled dates at the accommodation locations indicated in the programme
  • bring the equipment necessary for the programme (the equipment described by LaRébenne constitutes a recommended minimum)
  • have the insurance and assistance policies taken out, as well as the necessary administrative and police documents (visa, passport, etc.)
  • know basic emergency first aid procedures.

In case of obstacle to the planned programme, we invite you to contact LaRébenne or its correspondent, whose contact details appear in the travel booklet. Travellers are advised to have a mobile phone usable from the relevant country. Any programme modification at the initiative of one or more traveller(s) is carried out under their own responsibility and at their own expense.

Thus, as the tour takes place without a guide, LaRébenne's liability cannot be engaged, notably:

  • in case of non-observance of one of the above recommendations by one or more traveller(s)
  • in case of route error made by the traveller(s), personal fault and/or imprudence of the traveller(s)
  • in case of incident or accident occurring during the trip not attributable to LaRébenne.

Specific Conditions Applicable to Autonomy Trips: The tour takes place without a guide and, as such, under the full responsibility of each traveller. Each traveller must notably:

  • be able to read the maps provided and follow an itinerary with orientation equipment (compass, GPS)
  • be able to create and follow an alternative itinerary if needed (fatigue, mechanical problem, weather conditions, closed road or track, etc.)
  • handle mechanical problems
  • choose a departure time suited to the difficulty of stages and each traveller's cycling pace, allowing a wide safety margin
  • check daily weather conditions and safety conditions
  • have planned their accommodation conditions in advance
  • bring the equipment necessary for the programme (the equipment described by LaRébenne constitutes a recommended minimum)
  • have the necessary administrative and police documents (visa, passport, etc.)
  • have ensured they have assistance and repatriation insurance covering the area and planned activity
  • know basic emergency first aid procedures
  • have a mobile phone usable from the relevant country and ensure charging possibilities for this device.

Any programme modification at the initiative of one or more traveller(s) is carried out under their own responsibility and at their own expense. Thus, as the tour takes place without a guide, LaRébenne's liability cannot be engaged, notably:

  • in case of non-observance of one of the above recommendations by one or more traveller(s)
  • in case of route error made by the traveller(s), personal fault and/or imprudence of the traveller(s)
  • in case of incident or accident occurring during the trip not attributable to LaRébenne.

Liability and Risks Incurred: In accordance with the provisions of Article L211-16 of the French Tourism Code, LaRébenne's liability cannot be engaged in case of non-performance or poor performance of the contract attributable either to the buyer, or to the unforeseeable and insurmountable act of a third party unrelated to the provision of services under the contract, or to force majeure.

LaRébenne's liability cannot notably be engaged in case of:

  • non-presentation of proper administrative and health documents
  • loss by participant or theft of airline tickets
  • wars, political unrest, strikes, technical incidents, bad weather, air space congestion, delay particularly for safety reasons, breakdown, loss, theft, delay or deterioration of baggage and other effects, administrative authority orders, etc.
  • incident occurring during free time granted to the participant and not provided in the description, nor pre-transfers or post-transfers taken at the participant's initiative.

Furthermore, LaRébenne organises sports trips, in natural terrain called adventure terrain, sometimes far from local infrastructure and in difficult-to-access regions. Given the particular nature of our trips:

  • each participant must comply with the advice given in technical sheets and by the guide-leader, or in the travel booklet.
  • each participant must be aware that they may run risks of all kinds due to local conditions (poor road conditions and means of communication, distance from medical centres, political or health situation, etc.).

They assume them knowingly and undertake not to hold LaRébenne responsible. Similarly, LaRébenne cannot be held responsible for the individual imprudence of one or more participant(s), LaRébenne reserving the right to exclude, at any time, one or more participant(s) whose behaviour would endanger the group's safety or well-being, without any compensation being due to the participant.

Airlines' liability is limited in case of damage, complaint or claim of any kind (delay, cancellation, baggage loss, etc.) in accordance with the provisions of international conventions (Warsaw Convention of 1929, Montreal Convention of 28 May 1999) and/or EU regulations (Regulation EC 261/2004 of 11 February 2004). LaRébenne's liability cannot exceed that of the airline as resulting from the above rules.

LaRébenne cannot be held responsible for schedule or itinerary modifications caused by circumstances beyond its control. Under such conditions, any delay suffered by the participant and the consequences of this delay cannot result in any compensation payable by LaRébenne. Thus, participants cannot claim refund or compensation, particularly due to modification of initially planned flight dates or delay at an air stopover, etc. Any additional costs (taxes, hotel, parking, repurchase of transport tickets, etc.) will remain the participant's responsibility.

7/ Transport and Baggage:

Air Transport: A list of carriers likely to operate your flight is indicated in the trip's technical sheet. The name of the definitively selected company will be communicated to you at the latest upon your convocation. For all flights departing from Europe, we select only companies approved by the Civil Aviation Authority. In accordance with our obligation, we inform you that the European list of banned airlines can be consulted at http://ec.europa.eu/transport/modes/air/safety/air-ban_fr

If due to schedules imposed by airlines or any other carrier, the first and/or last night are shortened by late arrival or early departure, no refund, compensation or cancellation can take place. The airline may provide transport by any means (bus, train, etc.) in the event that the scheduled flight is cancelled or delayed. LaRébenne cannot be held responsible for routing difficulties. Airport or terminal changes may also occur. We invite you not to take non-refundable or non-modifiable tickets for your pre-routing and to avoid important appointments on the day before or after your trip. Finally, passengers have rights and guarantees regarding compensation and assistance in case of cancellation, overbooking or significant delay. Baggage: The airline is solely responsible for damage, theft, loss or delay of baggage entrusted to it. It is with this carrier that you must declare the claim as quickly as possible. International conventions define compensation due by the airline in case of loss or damage to baggage. During the trip, baggage may be transported by rudimentary means (mule or camel back, 4x4 roofs) and must be adapted to these conditions. LaRébenne will not pay any compensation in case of deterioration. Each participant must keep fragile and valuable objects (glasses, electronic devices, documents, etc.) with them at all times and under their responsibility. Each participant must ensure their baggage is present during transfer organisation.

8/ GDPR: The information collected about you is intended for use by LaRébenne and may be communicated to any service provider, possibly outside the European Union, for the performance of the subscribed service. In accordance with Law No. 78-17 of 6 January 1978 as amended in 2004, relating to information technology, files and freedoms, you have a right of access, modification, rectification and deletion for any information concerning you by contacting: Vélorizons, 273 rue Branmafan 73230 Barby. You may also, for legitimate reasons, object to the processing of data concerning you.

9/ Disputes:

Claim: Any claim relating to the trip must be addressed by the client to LaRébenne, Quality Service – 10 rue de la Comédie 09000 Foix – by registered letter with acknowledgement of receipt, no later than 1 month after the return date, accompanied by all supporting documents. After contacting the quality service and failing a satisfactory response within 60 days, the client may contact the Tourism and Travel Mediator, whose contact details are as follows: MTV Médiation Tourisme Voyage – BP 80 303 – 75823 Paris Cedex 17. Traveller's Rights: The combination of travel services offered to you is a package within the meaning of Directive (EU) 2015/2302 and Article L.211-2 II of the French Tourism Code. You will therefore benefit from all rights granted by the European Union applicable to packages, as transposed into the Tourism Code. LaRébenne will be fully responsible for the proper performance of the package as a whole. Furthermore, as required by law, Vélorizons has protection to refund your payments and, if transport is included in the package, to ensure your repatriation should it become insolvent.

Dispute: Subject to the defendant's capacity, any dispute falls under the exclusive jurisdiction of the Commercial Court of Grenoble.
